CallLatch Terms of Service

These Terms of Service ("Terms") are an agreement between you and CallLatch LLC ("CallLatch," "we," "us," or "our"). They cover your use of our website at getcalllatch.ai, our dashboard, our AI phone receptionist, our text services, and any related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you are signing up for a business, you confirm you are allowed to accept these Terms for that business.

1. What CallLatch does

CallLatch answers phone calls and texts for home-service businesses. It greets callers, collects job details, can book appointments on a connected calendar, and sends job summaries to you. It uses AI voice and language technology from third-party providers. The AI can make mistakes, so please review what it books and captures, and do not rely on it as your only way to handle emergencies.

2. Your account

You need an account to use the Services. Keep your login details safe and tell us right away if you think someone else has accessed your account. You are responsible for activity on your account. The information you give us about your business (hours, services, service area, pricing rules) should be accurate, because CallLatch uses it to talk to your callers.

4. Cancelling

You can cancel at any time. Cancellation stops future charges and takes effect at the end of your current billing period. We do not give refunds for partial months, except where the law requires it.

5. Your responsibilities

When you use CallLatch, you agree to: - Follow the laws that apply to your business, including laws on call recording, consent, telemarketing, and text messaging - Turn on a recording notice where the law requires one - Only have us text people who have agreed to receive texts from you, and honor opt-out requests - Not use the Services for anything illegal, harmful, deceptive, or abusive, or to send spam - Not try to break, overload, copy, or reverse engineer the Services

6. Your data

You own the information you and your callers give us, such as call recordings, transcripts, and job details. You give us permission to use it to provide, secure, and improve the Services for you. How we handle personal information is explained in our Privacy Policy.

7. Our property

CallLatch, including our software, intake playbooks, website, and brand, belongs to us. These Terms give you the right to use the Services while your subscription is active. They do not give you ownership of any part of them.

8. Third-party services

The Services rely on outside providers, such as phone carriers, voice and AI model providers, calendar providers, and payment processors. If you connect a third-party account, like Google Calendar, your use of that account is also covered by that provider's terms.

9. Availability and changes

We work to keep the Services running, but we cannot promise they will always be available or error-free. Phone networks, third-party providers, and maintenance can cause interruptions. We may change or improve features over time. If we make a change that materially reduces what you pay for, we will tell you in advance.

10. Suspension and termination

We may suspend or close an account that breaks these Terms, does not pay, or puts callers, other customers, or the Services at risk. Where it makes sense, we will warn you first. After an account is closed, we handle data as described in our Privacy Policy.

11. Disclaimers

The Services are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. CallLatch is not an emergency service. Callers with an emergency should call 911 or their local emergency number.

12. Limit of liability

To the extent the law allows, CallLatch is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or jobs. Our total liability for any claim about the Services is limited to the amount you paid us in the 3 months before the claim.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will tell you by email or in your dashboard before they take effect. If you keep using the Services after that, you accept the updated Terms.
